These Terms of Use explain the rules for using our website, www.dannygustinfitness.com, including its forms, articles, videos, scheduling links, downloads, and other online content. These Terms include the Privacy Policy as well as Copyright Policy and the Supplemental Disclosures posted on the website.
The website is operated by Danny Gustin Fitness LLC, doing business as Danny Gustin Fitness. In these Terms, “Danny Gustin Fitness,” “DGF,” “we,” “us,” and “our” refer to that business.
By using the website or submitting information through it, you agree to these Terms. Please do not use the website if you do not agree.
1. What This Website Provides
The website provides information about Danny Gustin Fitness and the services we may offer, including:

Information on the website is general. Visiting the website, submitting a form, or speaking with us does not automatically make you a client.
You become a client only after Danny Gustin Fitness accepts you into a program and all required agreements, waivers, health questionnaires, payment authorizations, and other onboarding documents have been completed.
2. Our Relationship With Partner Gyms
Danny Gustin Fitness may provide personal-training services inside gyms or fitness facilities owned, leased, or operated by independent businesses. We refer to these locations as “Partner Facilities.”
Danny Gustin Fitness and each Partner Facility are separate businesses.
Unless a written agreement specifically says otherwise:

Danny Gustin Fitness provides and manages the personal-training services.

The Partner Facility owns, leases, manages, or controls the building, equipment, common areas, parking areas, locker rooms, and other facility-related services.

Danny Gustin Fitness does not own or control the Partner Facility or its equipment.

The Partner Facility is responsible for maintaining and operating its premises and equipment.
-
Each business is responsible for its own employees, contractors, conduct, obligations, insurance, and legal compliance.
-
Neither business may make promises, sign agreements, or accept legal obligations on behalf of the other without written authorization.
Danny Gustin Fitness may have a revenue-sharing, profit-sharing, contractor, licensing, or similar business arrangement with a Partner Facility. That arrangement does not, by itself, create a legal partnership, joint venture, franchise, agency, employment relationship, or fiduciary relationship between the two businesses.
You may need to sign a separate gym membership agreement, guest agreement, facility waiver, or set of facility rules. Those documents are separate from your agreement with Danny Gustin Fitness.
Questions about personal training, programming, trainers, or scheduling should be directed to Danny Gustin Fitness.
Questions about gym membership, access, parking, locker rooms, building conditions, or equipment maintenance should generally be directed to the Partner Facility.
3. Fitness Services Are Not Medical Care
Danny Gustin Fitness provides fitness instruction, exercise programming, movement coaching, accountability, and general wellness education.
Unless a specific professional clearly states otherwise based on their separate license and qualifications, Danny Gustin Fitness does not provide:

Medical diagnosis or treatment;

Physical therapy;
-
Chiropractic care;
-
Rehabilitation services;
-
Mental-health counseling;
-
Prescription medication or supplement advice;
-
Treatment of injuries or diseases;
-
Emergency medical services; or
-
Clinical or therapeutic nutrition services.
Words such as “corrective exercise,” “pain reduction,” “mobility improvement,” “injury prevention,” “recovery,” or “post-physical-therapy training” describe fitness-related goals and services. They do not mean that Danny Gustin Fitness is diagnosing, treating, curing, or rehabilitating a medical condition.
The website and our general communications are not a substitute for advice from a physician, physical therapist, registered dietitian, or other licensed healthcare professional.
4. Talk to Your Healthcare Provider
Consult an appropriate healthcare professional before beginning or changing an exercise, nutrition, or wellness program, especially if you:

Have an injury, illness, disability, or medical condition;

Are pregnant or recently gave birth;

Recently had surgery;
-
Experience unexplained pain;

Have chest discomfort, dizziness, fainting, or unusual shortness of breath;

Take medication that could affect your ability to exercise;

Have been told to limit physical activity; or

Are unsure whether exercise is safe for you.
We may require medical clearance before allowing you to participate or continue in a program.
For a medical emergency, call 911 or seek immediate medical care. Do not use our website, email, social-media accounts, or text messages for emergencies.
5. Exercise Involves Risk
All exercise and physical activity involve risk.
Possible risks include:

Muscle soreness;

Strains and sprains;
-
Falls;
-
Equipment-related injuries;
-
Aggravation of an existing injury or medical condition;

Abnormal heart-rate or blood-pressure responses;
-
Serious injury;
-
Permanent disability; and
-
In rare situations, death.
This section is not a replacement for the separate informed-consent, assumption-of-risk, and liability-waiver documents that clients may be required to sign.
Before participating, you are responsible for:

Giving us complete and accurate information about your health, injuries, limitations, and exercise history;

Informing your trainer about any changes in your health, medication, pregnancy status, pain, or physical limitations;

Following trainer and facility safety instructions;
-
Using equipment only as instructed;
-
Exercising within your abilities; and
-
Stopping immediately and telling your trainer if you experience pain, dizziness, nausea, chest discomfort, unusual shortness of breath, or another concerning symptom.
6. Nutrition and Lifestyle Information
Any nutrition, sleep, stress-management, recovery, or lifestyle information we provide is intended for general educational and habit-coaching purposes.
It is not medical nutrition therapy and is not intended to diagnose or treat a condition, prescribe a therapeutic diet, or replace advice from a physician or registered dietitian.
You are responsible for considering your own:

Allergies and food intolerances;
-
Medical conditions;
-
Medications;
-
Dietary restrictions;
-
Religious requirements; and
-
Advice from your healthcare professionals.
7. Results Will Vary
Every person responds differently to exercise and lifestyle changes.
Results may depend on many factors, including:

Starting fitness level;

Age and genetics;
-
Medical conditions and medications;
-
Attendance and consistency;
-
Effort and program adherence;
-
Nutrition;
-
Sleep;
-
Stress;
-
Recovery; and
-
Activities outside the training program.
Danny Gustin Fitness does not promise or guarantee:

A particular amount or rate of weight loss;

A specific change in body composition;
-
A specific strength or performance result;
-
Elimination of pain;
-
Prevention of injury;
-
Correction of a medical condition;
-
A particular appearance; or
-
Results within a particular period.
Testimonials, before-and-after stories, and client reviews describe individual experiences. They do not guarantee that another client will receive the same or similar results.
8. Discovery Sessions and Assessments
A discovery call, complimentary session, trial session, consultation, or movement assessment allows us to learn more about your goals and determine whether our services may be a good fit.
These sessions are not:

Medical examinations;

Physical-therapy evaluations;
-
Medical clearances;
-
Diagnoses; or
-
Guarantees that we will accept you as a client.
We may decline, postpone, stop, or modify a session or program if we reasonably believe that you should first receive medical clearance, consult another professional, or use a different type of service.
Some programs may be available to teenagers or other minors.
A person under 18 may not enroll in services, sign an agreement, submit health information, or participate without the consent and involvement of a parent or legal guardian.
The parent or legal guardian must:

Complete the required agreements and waivers;

Provide accurate health and emergency-contact information;
-
Approve applicable payment arrangements; and
-
Make sure the minor follows our rules and the Partner Facility’s rules.
The website is not directed to children under 13. Children under 13 should not submit personal information through the website.
10. Prices, Payments, and Cancellations
The website may provide general information about programs, pricing, scheduling, or cancellation policies. Final terms will be stated in the client agreement, payment authorization, or program document you receive.
Those documents may address:

Pricing;

Recurring or automatic payments;

Session expiration;

Late cancellations;

Missed sessions;

Freezes or pauses;

Refunds;

Website descriptions are not a guaranteed offer of services at a particular price. Programs, trainers, schedules, availability, and prices may change.
Any cancellation or refund rights required by applicable law will apply even if a contract says otherwise.
11. Email, Telephone, and Text Communications
When you provide your telephone number or email address, you authorize us and the service providers working for us to contact you about:

Message frequency may vary. Standard message and data rates may apply.
You may stop promotional text messages by replying STOP. For assistance, reply HELP. You may unsubscribe from promotional emails by using the unsubscribe link or contacting us.
Even after you opt out of marketing, we may continue sending necessary non-promotional messages about appointments, transactions, safety, or services you are already receiving.
Please do not send highly sensitive medical, financial, or identification information through ordinary email, text messages, social media, or general website forms.

Danny Gustin Fitness does not make express or implied warranties about the website, including warranties that it will be:

For a claim arising only from use of the website, our total liability will not exceed the greater of:

The amount you paid directly to Danny Gustin Fitness for website-based services during the six months before the event giving rise to the claim; or

$100.
These limits apply only to the website and do not replace the terms of a separate client agreement or liability waiver.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
19. Responsibility for Misuse
To the extent permitted by law, you agree to protect and reimburse Danny Gustin Fitness and its owners, trainers, employees, contractors, and agents against claims, damages, liabilities, and reasonable expenses caused by:

Your unlawful misuse of the website;

Your violation of these Terms; or

Your violation of another person’s rights.
This provision does not require you to reimburse anyone for conduct for which reimbursement cannot legally be required.
20. Illinois Law
These Terms are governed by Illinois law, without applying rules that would require another state’s law.
Unless a signed client agreement provides a different lawful process, a dispute concerning only the website must be brought in a state or federal court that has jurisdiction in Will County, Illinois.
Either party may use small-claims court when the claim qualifies. Nothing in these Terms removes a legal right that cannot be waived.
21. Changes to These Terms
We may update these Terms from time to time.
The updated Terms will be posted on the website with a revised “Last Updated” date. Material changes will apply going forward unless applicable law permits otherwise.
Your continued use of the website after updated Terms become effective means that you accept them.
22. General Legal Terms
If part of these Terms is found to be invalid or unenforceable, that part will be limited or removed only to the extent necessary. The rest of the Terms will remain in effect.
Our failure to enforce a provision does not mean we have waived that provision or another right.
