A trainer may work within recommendations supplied by your licensed healthcare professional, but the trainer does not replace that professional.

PART C: RESULTS AND TESTIMONIAL DISCLOSURE

1. Results Are Individual

Client experiences, reviews, testimonials, before-and-after photographs, and success stories reflect the experiences of particular individuals.

They are not guarantees of what you will experience.

 

Your results may be different because results depend on factors such as:

• Starting condition;

• Medical history;

• Age;

• Genetics;

• Medication;

• Attendance;

• Effort;

• Nutrition;

• Sleep;

• Stress;

• Recovery;

• Consistency; and

• Compliance with the program.

 

2. No Guaranteed Outcome

Danny Gustin Fitness does not guarantee:

• Weight loss;

• Changes in body composition;

• Increased strength;

• Improved mobility;

• Reduced pain;

• Prevention of injury;

• A particular appearance;

• A specific athletic result; or

• Results within a stated period.

 

Statements about potential benefits describe goals or possible outcomes, not promises.

 

3. Testimonials Must Be Genuine

We seek to use genuine reviews and testimonials that reflect the person’s honest experience.

 

We will not knowingly:

• Publish a fabricated review;

• Misrepresent a client’s experience;

• Hide a material relationship that could affect the credibility of an endorsement; or

• Use a testimonial to make a claim that we could not legally make ourselves.

 

4. Incentives and Relationships

When a person receives a discount, free service, payment, gift, referral benefit, or another incentive in connection with a testimonial, review, or social-media post, we will disclose that relationship when required.

 

Employees, trainers, owners, family members, business partners, and other people with a material relationship to Danny Gustin Fitness should clearly disclose that relationship when publicly endorsing the business.

 

5. Client Images and Stories

We will use identifiable client photographs, videos, progress information, or personal stories only with appropriate permission.

 

A client may withdraw permission for future use when allowed by the applicable release and law. Withdrawal generally will not require us to recover or destroy materials that were lawfully published or distributed before the withdrawal.

 

 

PART D: PARTNER FACILITY DISCLOSURE

Danny Gustin Fitness provides personal-training services at facilities that may be independently owned, leased, or operated.

 

Unless expressly stated in writing:

• Danny Gustin Fitness does not own the Partner Facility;

• Danny Gustin Fitness does not own or maintain the Partner Facility’s equipment;

• The Partner Facility controls access to its premises;

• The Partner Facility is responsible for facility operations and maintenance;

• Danny Gustin Fitness manages the personal-training services it provides;

• The businesses are independent contractors; and

• Neither business has authority to bind the other.

 

Danny Gustin Fitness may compensate, or receive compensation from, a Partner Facility under a profit-sharing, revenue-sharing, rental, contractor, licensing, or similar arrangement.

 

The existence of a financial arrangement does not mean that the Partner Facility controls the professional judgment of a Danny Gustin Fitness trainer or that Danny Gustin Fitness controls the Partner Facility.

 

 

PART E: THIRD-PARTY PRODUCTS AND SERVICES

The website may mention or link to:

• Gyms;

• Equipment;

• Apps;

• Supplements;

• Clothing;

• Books;

• Websites;

• Online platforms;

• Healthcare professionals; or

Unless we clearly say otherwise, a mention or link does not mean that Danny Gustin Fitness:

• Controls the third party;

• Guarantees its product or service;

be treated as individualized medical or fitness advice.

 

Do not publicly post private medical, financial, or personal information in comments or reviews.

 

Danny Gustin Fitness is not responsible for comments, claims, links, or content posted by independent users or third parties.

PART G: TEXT-MESSAGE DISCLOSURE

 

By providing your mobile number and agreeing to receive text messages, you authorize Danny Gustin Fitness and service providers acting on its behalf to send messages concerning:

• Account administration;

• Payments;

• Safety notices; and
